Terms of Service

These Terms of Service ("Terms") govern your access to and use of the AICOMMI website at aicommi.com and the related services, tools, and features (together, the "Service"). The Service is operated by HONGKONG TBCC INDUSTRY CO., LIMITED, a company incorporated in the Hong Kong Special Administrative Region, with its registered office at Unit 04, 7/F, Bright Way Tower, No. 33 Mong Kok Road, Kowloon, Hong Kong ("Company", "we", "us", or "our").

By creating an account, connecting a supported third-party account, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What AICOMMI is

AICOMMI is a platform that helps you find relevant audiences and communicate across supported social networks, communities, media, and online platforms.

The Service may support discovery, communication, content preparation, organisation, and placement across:

Available features and methods of interaction may differ by platform. Depending on the platform and the functionality currently available, AICOMMI may help you discover relevant communities, channels, posts, discussions, or other public destinations; prepare or adapt messages; organise campaigns; and publish or send content using supported connection methods.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into these Terms. By using the Service you represent that you meet these requirements and that the information you provide is accurate and complete.

3. Your account

You may register using a supported sign-in method (for example email and password, or a third-party login). You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us at support@aicommi.com if you believe your account has been accessed without authorisation.

4. Connecting third-party platform accounts

Some Service features may require you to connect an account that you hold with a supported third-party platform. When you do so, you authorise the Company to establish and store the authorisation information or session necessary to perform, on your behalf and at your direction, the actions you request, subject to the functionality and rules of that platform.

For Telegram features, this may include establishing and storing an authorisation session that allows the Service to perform actions you request, such as joining a chat, publishing a comment, or sending a message.

5. Acceptable use

Your use of the Service is subject to our Acceptable Use Policy at aicommi.com/acceptable-use, which is incorporated into these Terms by reference. You are responsible for the content you create and send and for ensuring that your use of the Service complies with all applicable laws and the rules of any third-party platform you interact with.

6. Fees and prepaid balance

AICOMMI operates on a pay-as-you-go basis with no recurring subscription fee. Users may add funds to their AICOMMI account as a prepaid balance. The minimum top-up amount is USD 10.

The current standard price is USD 0.05 per successfully delivered message. A charge is deducted from the user's AICOMMI balance only when delivery is successfully confirmed. Undelivered messages are not charged.

For billing purposes, a message is considered successfully delivered when the relevant platform confirms successful submission or publication without an error. If a message is subsequently removed by a third-party administrator or moderator, the original delivery remains chargeable and does not automatically result in a refund.

New users may receive a USD 2 promotional balance. Promotional balance has no cash value, cannot be withdrawn or transferred, and may only be used for eligible AICOMMI services.

Prices and applicable payment terms are displayed before purchase or use. Payments for balance top-ups may be processed by third-party payment providers and may be subject to their applicable terms.

We may change our prices in the future. Any new price will apply prospectively and will be communicated before it becomes effective.

7. Intellectual property

The Service, including its software, design, text, and branding, is owned by the Company or its licensors and is protected by applicable laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms.

You retain all rights to the content you create. You grant us a limited licence to process and transmit that content solely to operate and provide the Service to you.

8. Third-party services

The Service interoperates with third-party platforms and service providers. These may include Telegram, Instagram, YouTube, TikTok, Twitter / X, LinkedIn, Reddit, Facebook, Twitch, Discord, Media & News, and Blogs & Forums, as well as our hosting, infrastructure, and payment providers.

Those third parties operate independently. They may modify, restrict, suspend, or discontinue their services, features, APIs, or access to any account at their own discretion and under their own terms. We do not control and are not responsible for their acts, omissions, availability, or decisions, including measures they may apply to your account or content.

9. Disclaimers

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that it will produce any particular audience, response, deliverability, or commercial outcome.

10. Limitation of liability

To the fullest extent permitted by law, the Company and its directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to your use of (or inability to use) the Service. To the fullest extent permitted by law, our total aggregate liability arising out of or related to the Service will not exceed the greater of (a) the amount you paid us for the Service in the three months preceding the event giving rise to the liability, or (b) USD 100.

11. Indemnification

You agree to indemnify and hold harmless the Company from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your content, or your breach of these Terms, the Acceptable Use Policy, or any applicable law or third-party rules.

12. Suspension and termination

We may suspend or terminate your access to the Service if you breach these Terms or the Acceptable Use Policy, or where required to protect the Service, other users, or third parties.

You may stop using the Service at any time. You may disconnect supported third-party accounts where that functionality is available and delete your AICOMMI account and associated data from your account settings. Deletion removes your personal data as described in our Privacy Policy at aicommi.com/privacy, subject to any retention we are required or permitted to apply by law.

13. Changes to the Service and these Terms

We may modify the Service and update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing law and disputes

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-laws rules. The courts of Hong Kong will have jurisdiction over any dispute arising out of or relating to these Terms or the Service, subject to any mandatory rights you may have under the laws of your country of residence.
